C11-04 - Agreement to Provide Storage for Motor Vehicle Impounds - American Towing6isi> > AGREEMENT TO PROVIDE STORAGE FOR MOTOR VEHICLES IMPOUNDED BY THE BEAUMONT POLICE DEPARTMENT THIS AGREEMENT is made and effective this � day of June, 2011, by the CITY OF BEAUMONT, through its POLICE DEPARTMENT, a public entity (collectively, "the CITY "), and ALL AMERICAN TOWING, INC., 2671 West Lincoln Street, Banning, California 92202 (telephone 951- 849 -9555) ( "the CONTRACTOR "). RECITALS A. From time -to -time, the CITY's Police Department impounds motor vehicles of all types and sizes, which vehicles are considered evidence in various civil and criminal matters. The CITY needs a place to temporarily store such vehicles. B. CONTRACTOR represents that it has a secured indoor storage facility that will safely accommodate such vehicles. C. It is the purpose of this Agreement to set forth the terms and conditions by which the CITY will utilize the CONTRACTOR's facility. AGREEMENT 1. Description of Services. The CONTRACTOR hereby agrees to provide an indoor motor vehicle storage facility for use by the CITY, which facility shall have the following capabilities: a. The facility shall be capable of holding up to 3 motor vehicles, including recreational vehicles; b. The facility shall be kept locked and secured, and equipped with an operational alarm system and surveillance cameras with color videotaping capability; C. The facility shall have at least one 110 volt electrical outlet that may be used by the CITY's Police Department representatives to operate tools and equipment used for investigative purposes; and d. That Police Department representatives and agents have 24- hour -a -day, 7- day -a -week access to the motor vehicles. 2. Compensation. The CITY agrees to pay, and the CONTRACTOR agrees to accept, compensation in the following amounts for the following purposes: a. For towing such motor vehicles: $50.00 per tow; b. For storage: $3.00 per day for vehicle. 3. Contact Person. The CONTRACTOR hereby appoints Briana Haberman, contractor's General Manager, as the primary contact person and representative of the CONTRACTOR concerning the implementation of this Agreement. CONTRACTOR may designate, from time -to -time, a substitute contact person, and agrees to promptly provide the name and other contact information to the CITY's Chief of Police or his or her designee. 4. Term of Agreement; Termination. The initial term of this Agreement shall be 12 calendar months from the date first above written, and may be renewed thereafter by mutual agreement of the CITY and of the CONTRACTOR. Notwithstanding the initial term specified in the preceding sentence, the CITY reserves the right to terminate this Agreement, without cause, upon 10 days' prior written notice and removal of any vehicles in the facility, without further liability to CONTRACTOR, except for compensation earned on and prior to the date the last vehicle is removed from CONTRACTOR's facility.
